Trademark Use and Protection Guidelines

These guidelines are for Lucky Goat licensees, authorized resellers, customers, and other parties wishing to use Lucky Goat’s trademarks, service marks or images in promotional, advertising, instructional, or reference materials, or on their web sites, products, labels, or packaging. 

Use of Lucky Goat trademarks for commercial purposes without the prior written consent of Lucky Goat may constitute trademark infringement and unfair competition in violation of federal and state laws.  Use of Lucky Goat trademarks may be prohibited, unless expressly authorized.

Lucky Goat trademarks, service marks, trade names, and trade dress are valuable assets. They distinguish Lucky Goat products and services from those of Lucky Goat competitors and they signify to the public the high quality of those products and services. In following these guidelines, you help us protect valuable trademark rights and strengthen our corporate and brand identities.  By using a Lucky Goat trademark, in whole or in part, you are acknowledging that Lucky Goat is the sole owner of the trademark and promising that you will not interfere with Lucky Goat’s rights in the trademark, including that you will not harm, misuse, or bring into disrepute any Lucky Goat trademark.  The goodwill derived from using any part of a Lucky Goat trademark inures to the benefit of and belongs to Lucky Goat.  Except for the limited right to use as expressly permitted under these guidelines, no other rights of any kind are granted hereunder, by implication or otherwise. 

1. Authorized Use of Lucky Goat Trademarks

Advertising, Promotional, and Sales Materials: Only Lucky Goat and its authorized resellers, authorized retailers and other licensees may use the Lucky Goat trademarks in advertising, promotional, and sales materials.  Such authorized parties may use the Lucky Goat trademarks only as specified in their agreement with Lucky Goat and in accordance with these Guidelines and such use must always be in conjunction with the appropriate terms that define the relationship authorized by their contract with Lucky Goat. 

Fundraising Materials:  Authorized fundraising organizations may use the Lucky Goat trademarks in the fundraising materials provided or approved by Lucky Goat.  Such authorized organizations may reproduce the fundraising materials but may not reproduce the Lucky Goat trademarks apart from such fundraising materials without the express written permission of Lucky Goat. Lucky Goat may provide replacement or updated fundraising materials and revoke the right to use prior fundraising materials at any time. 

Proudly Serving Program Materials:  Authorized restaurants serving Lucky Goat products may display Lucky Goat “proudly serving” materials provided by Lucky Goat.  Such authorized entities may not reproduce the “proudly serving” materials without the express written permission of Lucky Goat. Lucky goat may provide updated “proudly serving” materials at any time and revoke the right to use prior “proudly serving” materials. 

1. Guidelines for Proper Use of Lucky Goat Trademarks in the US for Authorized Parties

The following guidelines set out proper (and improper) use of Lucky Goat trademarks in the US. These guidelines should be followed whenever the Lucky Goat trademarks are used in the US. These materials include all advertising and promotional materials, including online materials, retail signage and product packaging.

Use Lucky Goat Trademarks as Proper Adjectives Followed by a Generic Term. Trademarks should be used as adjectives followed by a generic term, and not as nouns or verbs. For example:

• Correct: Lucky Goat coffee tastes great.
• Incorrect: Lucky Goat tastes great.

Do Not Use Lucky Goat Trademarks in the Plural or Possessive Form. Because trademarks are not nouns they should not be used in the plural or possessive form, unless the trademark itself is in the plural or possessive form.

For example:

• Correct: I bought two bags of Snowflake Crunch coffee today.
• Incorrect: I bought two bags of Snowflake Crunches

Do Not Alter Lucky Goat Trademarks. Trademarks should be used consistently and should not be altered. For example, do not:

• Abbreviate the trademarks.
• Change the colors or typeface of the trademarks.
• Add words or design elements to the trademarks.
• Hyphenate the marks unless the trademark itself is hyphenated.

Use Proper Trademark Notice Symbols. Proper trademark notice symbols should be used with Lucky Goat trademarks. In the US, the proper symbol to use depends on whether the trademark is registered with the US Patent and Trademark Office for the specific products or services for which the mark is used:

• Use the registered trademark symbol ® with registered Lucky Goat trademarks but only if the trademark is registered with the US Patent and Trademark Office for the specific products and services for which the trademark is used. A list of Lucky Goat trademarks can be found at the bottom of this page including the products and services for which they cover and the proper placement of the trademark symbols and their placement.
• If the trademark is not registered in the US Patent and Trademark Office, use the symbol:
  • "TM" with trademarks used to identify products.
  • "SM" with trademarks used to identify services.
  • "TM" with trademarks used to identify both products and services.

The appropriate symbol should appear immediately following the mark. 

Disparaging Manner.  You may not use a Lucky Goat trademark in a disparaging manner.

Attribution.  Include an attribution of Lucky Goat as the owner of its trademarks within the marketing, promotional, signage or product materials.

Brand Identity Standards.  Adhere to the Lucky Goat brand identity standards (“Style Guide”) when using Lucky Goat trademarks.  A copy of the Style Guide can be found on the Lucky Goat website, at https://luckygoatcoffee.com/pages/brand-guidelines.
